The Court held that on the evidence, including subsequent leases and the 20 April 2002 deed together with the liquidator of Formwork Construction's consent, title to the Climetrac had passed to Formwork Hire prior to liquidation; the appellants had no arguable defence or standing and no evidential basis for a possessory lien, therefore summary judgment was properly entered and the appeal dismissed.
