Leave to adduce further evidence was refused because the proposed affidavit and exhibits were largely not fresh and were available to the Deputy Registrar, the s 385 statutory scheme contemplates a summary protective inquiry (not a rehearing), there was no breach of natural justice warranting remediation, much of the material was irrelevant or inadmissible opinion, and admitting the evidence would undermine the bespoke prohibition regime and risk an improper de novo rehearing.
