The District Court judge was correct: the subcontract with GKC was not frustrated or discharged; GKC's project manager did not have actual or apparent authority to bind BLM to a large contract; BLM did not ratify the purchase order at the April 2010 meeting; consequently Roofing Specialists' claim against BLM fails and the appeal is dismissed.
