LI v POLICE [2023] NZHC 3729

The Court held that although the offending was at the lower to moderate end of the indecent assault scale once mitigation was considered, the exposure to liability for deportation was speculative and not of such immediacy or severity in this factual context (no present family upheaval, opportunity for immigration scrutiny and ministerial discretion) that it was out of all proportion to the gravity of the offending; accordingly the refusal to grant a discharge without conviction was upheld.

TILLER v R [2023] NZHC 1050

The appeal is dismissed because the breaches of protection orders and resisting arrest were of moderate gravity, the adverse employment and travel consequences were not shown to be out of all proportion to that gravity, and the sentencing judge correctly applied s107 and properly exercised discretion under s106; the 12 months' supervision sentence was not manifestly excessive and was imposed for rehabilitative purposes.

K v NZ POLICE [2023] NZHC 3641

Given the low-to-medium gravity of the assault, the material change of circumstances (quashing and acquittal on the more serious charges), admission of fresh evidence, and the realistic and appreciable risk that a conviction would significantly impair the appellant's prospects of returning to New Zealand and seeing his daughter, the Court held the direct and indirect consequences of conviction were out of all proportion to the gravity of the offence under s 107 and therefore quashed the conviction and discharged the appellant without conviction under s 106.

NOORI v NEW ZEALAND POLICE [2023] NZHC 3799

On rehearing the Court found no material error in the District Court Judge's application of the three-step proportionality test: the offending was correctly assessed as low gravity and the demonstrated consequences (citizenship delay, increased travel difficulty, speculative employment effects) were not shown to be out of all proportion to that gravity; therefore no miscarriage of justice and the appeal is dismissed.

SONG v NEW ZEALAND POLICE [2023] NZHC 3324

In the absence of compelling or expert evidence showing a real and appreciable risk that a drink-driving conviction would cause cancellation or inability to obtain the TTPS visa or temporary visas (Australia, USA, UK), and given that the cited family and business harms were speculative or ordinary consequences of conviction, the District Court judge did not err in declining a discharge; the High Court dismissed the appeal and upheld the conviction and sentence.

WARREN v NEW ZEALAND POLICE [2023] NZHC 2965

BURNS v NEW ZEALAND POLICE [2023] NZHC 2585

TUMAHAI v R [2023] NZCA 431

The appeal was allowed because a miscarriage of the sentencing process occurred: an application for discharge without conviction was never advanced through no fault of the appellant, effective representation was lacking at sentencing, and credible fresh evidence was now available that created a real possibility a different outcome would have occurred; accordingly the convictions were set aside and the matter remitted to the District Court for full reconsideration with the benefit of the fresh evidence.
