The proceeding was struck out as a plain abuse of process because there is no statutory basis to appeal an LCRO decision to the High Court, the only appeal provision in the Lawyers and Conveyancers Act (s 253) applies to Disciplinary Tribunal decisions, the named respondents were incorrect, and the filing was made in the wrong registry.

Because the Authority was the successful party in both the interlocutory application and the substantive appeal, and the Court was satisfied the itemised time and disbursement were appropriate, the appellant was ordered to pay costs calculated at 7.85 days at the Schedule 2 recovery rate of $2,230/day ($17,505.50) plus a $50 disbursement, totaling $17,555.50.

The Judge refused recusal because the disclosed past professional and limited personal associations did not give rise to a reasonable apprehension of bias; however, because the Full Court had delivered a decision that might materially affect the pending costs and security applications, the hearing for 25 August 2014 was vacated and a timetable for further submissions was ordered to permit consideration of the Full Court outcome and any appeal, with costs reserved.
