HGL was the overall successful party because the Council's decision was quashed and remitted; nevertheless a substantial costs reduction (60%) from HGL's scale entitlement was warranted because HGL's unsuccessful substantive legitimate expectation claim and other failed arguments materially and disproportionately increased the Council's costs; disbursements awarded in full except that 60% reduction applied to the expert witness fees of Mr Baikie; second counsel certified.
