On the balance of probabilities the judge found sufficient evidence that the 28 January 2003 accident caused sensitisation and annular injury to the L5/S1 disc and was a substantial cause of the condition requiring surgery; therefore the ACC decisions declining cover were set aside and the appeal allowed.
