The application for non-party access to the Court file under r 3.9 is declined because the applicant's purpose was essentially private and the relevance of the material to the Cayman winding up petition was insufficiently established; alternative discovery procedures exist in the Cayman Islands which are the appropriate forum to determine relevance and supervise disclosure; disclosure here would risk undermining confidential and commercially sensitive material and would effectively circumvent existing Cayman discovery orders, thereby prejudicing the orderly and fair administration of justice.
