Because the decision was made 19 March 2002 but the review application was filed after 1 April 2002, s391 of the 2001 Act brings the matter within Part 5 of the 2001 Act; accordingly s135(3) applies and confers discretion to accept a late application for extenuating circumstances. Appeal allowed and matter remitted for a review hearing to determine extenuating circumstances and hear merits.
