The Court held ACC correctly assessed the overpayment and, after crediting criminal reparation, retains the statutory power under s77(1) to recover the remaining $14,350; s77(9) is an administrative discretion for ACC alone and does not give rise to a right of review or appeal to the Court; consequently the appeal is dismissed.
