The Court awarded costs to the first respondent but exercised its discretion under rr 14.1 and 14.7 to reduce the claimant's claim for preparation of submissions by 50% because, while the appellant bore ultimate responsibility for non‑payment of security, the respondent's post‑due‑date work was partially avoidable; accordingly costs of $4,460.00 were allowed.
