Section 121(1) of the Accident Compensation Act 2001 mandates that the Corporation must not provide entitlements in respect of any period during which the claimant is a prisoner; that mandatory disentitlement applies irrespective of later quashing of conviction or unfair trial, and s 117 cannot be used to provide relief where no s 117 decision was made; accordingly the appellant is not entitled to weekly compensation for the periods of imprisonment and the appeal is dismissed.
