The High Court upheld the District Court judge's refusal to dismiss/stay charges because the judge properly applied s 322 and youth justice principles, made no material error of fact or law in assessing delay, prejudice, rehabilitation prospects and the restorative justice context, and the referral to Project Restore was not improper; judicial review is available but should be pursued promptly and sparingly and relief was declined.
