The application to set aside the bankruptcy notice was dismissed because the debtor could not demonstrate cross-claims equal to or exceeding the $7,000 judgment that were incapable of being raised as a defence in the Disputes Tribunal, and the remaining claims lacked sufficient evidential foundation to constitute genuine and triable cross-claims under s 17.
