The High Court held that the amended application under s74(8) provided the appropriate statutory basis and, having reviewed the materials, granted the orders in terms of the amended application dated 8 April 2019 to discharge the Scheme of Repair and enable distribution of the surplus levies as resolved by the Body Corporate committee.
