Court held the s161 certificate dated and signed on or about 1 February 2008 lacked reasonable grounds so $34,591 paid to Mr Gee must be repaid; Mr Gee breached ss135 and 137 by permitting trading and incurring liabilities after 1 October 2007 (objective test) and caused creditor loss; under s301 Mr Gee ordered to pay NZD 49,761.12 as compensation; interest at 5% from 18 April 2012 and costs to plaintiffs awarded.
