The District Court Rules require solicitors to have and warrant actual authority from the named party to file and conduct proceedings; an ACC administrative authority form (ACC5937) does not, as a matter of law, confer authority to initiate District Court proceedings or operate as a power of attorney for that purpose; because the requisite authority had not been shown the Court directed that valid written authority be filed within 14 days and that the appellant attend the hearings to confirm informed consent, failing which both appeals will be struck out.
