On the evidence Google New Zealand Ltd did not own, operate or control the Google Search Service or the domain and lacked the ability to block or remove search results; therefore the plaintiff's claims were not reasonably arguable against that defendant and summary judgment was appropriate for the defendant; however the broader legal question whether search engines are publishers is novel and requires full hearing, so strike out was inappropriate.
