Rule 20.22 High Court Rules is inapplicable because the Domestic Violence Act 1995 and its s93 require that any leave to appeal from the High Court to the Court of Appeal be sought from the Court of Appeal; therefore the applicant must apply to the Court of Appeal for leave and for an extension of time. The repeal of the DVA by the Family Violence Act 2018 does not change this outcome due to the transitional provision.
