The court found the deceased made an enforceable testamentary promise which the claimant relied on by providing financial contributions and maintenance; competing claims were minimal and not pursued by the surviving spouse; accordingly it was reasonable to vest the Preston Road property in the claimant subject to the existing ANZ mortgage, with the vesting conditional on filing an affidavit proving personal service and an affidavit confirming statement of claim allegations.
