On the summary application the court could not conclude the caveat was patently unsustainable: the applicant has an arguable case that the payments gave rise to a resulting trust rather than a mere unsecured loan or a family debt repayment; accordingly the caveat is to be sustained pending substantive proceedings, subject to conditions (no undertaking as to damages ordered).
