The High Court held the sentencing Judge did not err in imposing imprisonment: given the appellant's recent serious driving history, the fatality, and the absence of confidence he would refrain from driving, imprisonment was necessary for deterrence, denunciation and community protection and home detention was not the least restrictive adequate option.
