    LENIHAN v R [2020] NZHC 2543

    Citation
    [2020] NZHC 2543
    Court
    High Court

Given the planning and sophistication of both pharmacy burglaries, the theft of controlled drugs causing real community harm, the damage caused, the value taken and the appellant's extensive relevant offending (recidivist burglaries and contemporaneous sentence), a starting point of three years six months for the combined offending was within range; the District Court's uplifts and discounts were appropriate and the resulting end sentence of three years' imprisonment was not manifestly excessive, so the appeal is dismissed.
