The additional assessment was admitted but did not establish that methamphetamine addiction causally produced the offending; the judge did not err in allowing only a two month discount for addiction and the overall sentence of two years and four months' imprisonment was not manifestly excessive, so the appeal is dismissed.

Appeal allowed in part: the High Court held the District Court erred by effectively double‑counting the additional offences and failing to acknowledge EM bail; the proper disposition is that the 18‑month sentence for assault with intent to injure and breach of a protection order must run concurrently with the three‑year strangulation sentence, and the three‑year sentence on strangulation remains appropriate when modest credit for EM bail is factored in.

The High Court held the judge's starting point of two years six months for the violence, plus a six-month uplift for breaches of a protection order, was available and appropriate given the aggravating features (including strangulation and threats to kill); the discounts applied (EM bail, remorse, rehabilitation and guilty plea) were within discretionary bounds and did not render the end sentence manifestly excessive, so the appeal is dismissed.
