The application for costs was declined because the first respondents did not act so unreasonably as to attract an adverse costs order; consistent with Synlait and North Holdings, an unsuccessful objector to a s 317 application who acts reasonably is protected from a costs award, and the matter was resolved by consent without filed opposition.
