HOLROYD v HOLROYD [2020] NZHC 1210

- High Court
The High Court dismissed the appeal and upheld the Family Court's s15 award of $100,000 because the Family Court properly found a clear division of functions with the respondent as primary caregiver, that this produced a significant disparity in future earning capacity, that the value and income‑generating capacity of the appellant's shareholdings were relevant, and that a $100,000 compensatory award (about 10% of the appellant's share) was just and did not create an injustice; interest is payable from the Family Court judgment date under s87 Judicature Act 1908.
