The caveat was originally lodged by trustees to protect the Trust's equitable interest when the registered proprietor was the first respondent; subsequent orders vested the property in the current trustees so the original ground for the caveat has been extinguished and the caveat serves no practical purpose; the application affected only the applicants and service on the former trustee was dispensed with; accordingly under s 142 the caveat was removed as the test of patent clarity was met.
