Because the applicant discontinued the judicial review, Rule 15.23 applies and the applicant must pay the defendant's costs; the applicant's bankruptcy does not prevent such an award; the quantified and particularised claim of $19,848 was reasonable and is ordered payable by the applicant.

Court awarded costs to the second and third respondents on a 2B basis except that preparation of written submissions was assessed at 2A, allowed the claimed disbursements including car hire and parking, reduced the claimed items (including halving the commencement item) resulting in costs of $8,955, and ordered Mr Henderson and GP96 Limited to be jointly and severally liable while declining to determine the bankruptcy incidence issue.

Because of the second defendant's conduct in prosecuting and defending these proceedings, including refusal to limit issues and use of documents improperly, the Court awarded solicitor/client costs against him to be paid from the fund by the Public Trustee subject to approval of quantum upon production of detailed bills; no costs order was made against Mrs Wadsworth at this time though she was warned about future exposure.
