The application to recall was refused because the Court lacked jurisdiction to recall a judgment after a formal record had been drawn up and sealed under Rule 533(3); alternatively, on the merits Mahaki v ACC did not affect the applicant because s442 did not apply (no prior lump sum) and had been repealed, so Mahaki was irrelevant to the commencement date for this applicant's Independence Allowance.
