The Court granted the application to cancel Unit Plan 47522 because the units were demolished, a special resolution of owners holding more than 75% unit entitlement approved cancellation, the application and supporting material had been served on registered proprietors as directed, and the Court was satisfied the relief sought was appropriate; accordingly the Court ordered cancellation and directed that sale and insurance monies be applied according to the unit entitlements on Deposited Plan 47522.
