Sutherland v Accident Compensation Corporation
- Citation
- [2002] NZACC 21
- Court
- District Court
On the balance of probabilities the appellant failed to establish that her ongoing back problems are causally connected to the 26 October 1988 covered accident; medical evidence showed a pre-existing congenital spondylolisthesis with subsequent degenerative change that is the substantial cause of current incapacity and is excluded by s.10, so the Corporation's decision to cease entitlements was lawful and the appeal is dismissed.
