The appellant's activity is repair and maintenance of electricity distribution lines (distribution work), distinct from transmission/construction; the regulations, not ANZSIC alone, govern classification; because the appellant's activity is distribution maintenance it should not be classified under 41220 and the file is to be returned to the respondent to create a new classification for 'electricity distribution work' with a premium rate not exceeding class 36101, accordingly the appeal is allowed.
