There was no credible contemporaneous evidence that an accident sufficient to cause the L5/S1 disc prolapse occurred on 3 December 2010; employer and GP records and prior history demonstrated long-standing back problems including sciatica, and specialist opinions premised on a later-provided accident history were unreliable; therefore ACC correctly declined cover and the decision was properly upheld on review and appeal.
