The defendant intentionally encouraged an armed co-actor to stab the deceased but because the encouragement was virtually contemporaneous with the stabbing and it could not be established that the words prompted the fatal act, culpability was reduced; applying parity and mitigation (youth, traumatic cultural background, time on electronically monitored bail) produced a starting point of 3 years 9 months reduced by 12 months to a final sentence of 2 years 9 months imprisonment for manslaughter.
