The Privacy Act provides a self-contained statutory scheme for complaints about IPP breaches and, except for specific rights in s 11(1), the IPPs do not confer court-enforceable rights; the applicant had not exhausted the statutory route and thus the High Court should not exercise judicial review in these circumstances, and the challenge to the POM provision as inconsistent or ultra vires was unsustainable; the respondent's application to dismiss is granted.
