Heazlewood v Accident Compensation Corporation

- District Court
Because cover was originally granted in 1988, the 1982 Act definition applies; respondent failed to establish that the appellant's current disability is exclusively caused by disease, ageing or a gradual process—medical evidence (Dr Tait, Dr Franzmayr) and concessions in Dr Bonkowski's report indicate a causal contribution from the 1976 accident—therefore entitlements should not have been ceased and cover is restored.
