Medical and radiological evidence established that appellant's ongoing back condition was caused wholly or substantially by pre-existing and progressive degenerative spinal disease (over 85% contribution); therefore exclusion for ageing applied and ACC had a sufficient basis to be 'not satisfied' of entitlement, so leave to appeal was refused and appeal dismissed.
