The Court, on the balance of probabilities, preferred the treating spinal specialist's evidence and found a probable causal link between the 1996 lifting accident and a focal L5/S1 disc failure (distinct from a generalized degenerative process); accordingly the need for the proposed surgery arises from the original covered injury and the appeal is allowed.
