Leave was granted despite inordinate delay because the merits and overall justice favoured the appellant; the weight of contemporaneous medical evidence (MRI and specialist reports of Dr Harrison, Mr Rao and Mr Hoffman) established that a lumbar disc prolapse arising from the 4 February 2000 workplace lifting episode was a substantial and operating cause of the appellant's ongoing incapacity, so the decision to cease entitlements was quashed and entitlements reinstated from the date of cessation.
