Section 53(3) of the Employment Relations Act 2000 is not a "requirement" or "restriction" requiring compliance within the meaning of s15(1) of the Epidemic Preparedness Act 2006; consequently cl 8 of the Immediate Modification Order purported to amend primary legislation beyond the s15 power and was invalid ab initio; declaration of invalidity must be made.
