Rule 15.24 applied because the new proceeding arose out of the same facts as the discontinued proceeding; the plaintiff was not entitled to commence the new proceeding until he paid the costs ordered in the earlier proceeding, and the appropriate remedy was to stay the current proceeding under r 15.1(3) until those costs were paid.
