The High Court held there was no breach of natural justice or procedural unfairness: the Tribunal had granted an adjournment, the applicant had sufficient time and access to advice, telephone attendance was appropriate, and the purported new evidence was not fresh or could have been obtained earlier; the Tribunal's and District Court's factual conclusion that the plans showed three ducts was reasonable and not amenable to judicial review; accordingly the application for judicial review was dismissed and costs awarded to Chorus on a 2B basis.
