On the proved facts the appellant's touching of the complainant's back and buttocks under her T-shirt while she was his client amounted to activity of a sexual nature and conduct unbecoming; the Tribunal was entitled to take the earlier photography incident into account as contextual evidence of sexual motivation; and the public interest in openness and protection of potential clients outweighed the appellant's interest in suppression, so the Tribunal's suppression order as to the appellant's name was reversed by this Court.
