The prior uncharged incident was admissible as relevant propensity/background evidence tending to show hostility and a tendency to unprovoked assault relevant to self-defence and identity; the trial judge's directions did not produce unfair prejudice or confusion warranting overturning the convictions; extension of time to appeal was granted but the appeal was dismissed and convictions and sentence upheld.

The Supreme Court dismissed the appeal: prison‑inmate admissions were admissible, s122 warnings given by the trial Judge were adequate and tailored to the facts, propensity evidence under s43 was highly probative of the sexual jealousy motive and the defendant's tendency to extreme violence and its probative value outweighed unfair prejudice, and taken as a whole no miscarriage of justice arose from admission of the evidence or the directions given.
