The Supreme Court dismissed the application for leave: knowledge by a juror of potential but uncalled character evidence did not satisfy the exceptionally high threshold in s 76(3) to permit inquiry into jury deliberations and there was no appearance of a miscarriage of justice; the conviction on count one was properly supported and not unsafe.
