The court accepted the findings of the court-appointed expert as to the validity and quantum of the claims by Conway Madison, Buck, Dacombe and Ward and ordered distribution pro rata to those claims because the expert's factual and evidential basis was adequate; the Cleveland claim was rejected for lack of primary corroborating evidence showing the original advance, receipt of benefit by the trust and trustee approval of any assignment; an adjournment was refused because of non-compliance with disclosure directions and lack of satisfactory medical evidence.
