The Court was satisfied the letter of request was in substantial compliance with Hague Convention requirements and met s 184 prerequisites, that s 185 empowered the Court to order sworn oral examination and authentication/transmission of documents, that proceeding without notice was justified because notice would cause delay and prejudice to the applicant's US defence and the examinations were limited and not oppressive; accordingly the Court exercised its discretion to grant the requested orders for examination, transcript, authentication and transmission, with costs met by the applicant.
