Leave to appeal refused because the District Court's factual finding—that the calcific tendinitis pre-existed and was merely rendered symptomatic by the August 2008 fall—was supported by the evidence and did not raise any bona fide and serious question of law for the High Court to determine.

On the evidence the appellant's significant ongoing pain and depression were a continuation of pre-existing conditions dating to 1999; the head injury at most exacerbated those conditions and there is insufficient evidence that the head injury caused the ongoing pathology; accordingly CRM was entitled to suspend entitlements under s117 and the suspension is upheld.

On the balance of probabilities the appellant's bruxism was caused by and arose as a consequence of her accepted injuries (the 1993 motor vehicle accident and the 1996 sexual abuse) rather than being a pre-existing bruxism condition; accordingly ACC must meet past and future treatment costs for the bruxism and related dental care.
