On the evidence from the post-examination financial records and the conduct of the director after judgment, the Court found the company had capacity to make monthly payments and that an instalment order under r 17.17(1)(b) was appropriate; accordingly the Court ordered Hewitt Building Ltd to pay $8,000 per month commencing 1 March 2022 until the judgment debt of $392,400 and interest (from 18 June 2021) was fully satisfied.
