The Criminal Rules did not cover this appeal and the Costs in Criminal Cases Act did not apply; therefore the Civil Rules applied and the respondents were entitled to costs under r53, resulting in an award of costs and disbursements equal to the security for costs paid ($5,560) and authorisation for the Registrar to pay the security to respondents' counsel.

There was reasonable cause to believe the respondent could answer questions and produce documents concerning ownership of the two vehicles allegedly purchased with proceeds of crime, and therefore an examination order under s 106 of the Criminal Proceeds (Recovery) Act 2009 was justified and must be granted.

The Court found beyond reasonable doubt that the respondent deliberately and flagrantly disobeyed the judgment and subsequent orders, establishing civil contempt; because the respondent had been adjudicated bankrupt and assets vested in the Official Assignee sequestration was impractical, so the appropriate remedy was an order for indemnity (solicitor/client) costs rather than sequestration, imprisonment or fine.
